On February 8th, the U.S. District Court for the Southern District of New York confirmed the jury’s verdict, ruling in favor of Hermès. It stated that the MetaBirkins NFTs series created and sold by American NFT artist Mason Rothschild, also known as Sonny Estival, was done so without authorization. It was found to have the potential to confuse consumers and was accused of trademark infringement, trademark dilution, and domain name hijacking.
